By choosing to accept a quote, and purchase services from fishtalesstudio.com, you agree to the following terms of service which apply to the sites, www.fishtalesstudio.com and all pages contained within the site:

COPYRIGHTS:

ANIMATE CARTOON AND VIDEO DESIGN:

Ownership (copyright and title) of the final artwork becomes the property of the client, having unlimited, indefinite, and royalty-free use of the image upon project completion and receipt of full payment. fish tales studio retains rights to display the artwork in portfolio and advertising materials. All concepts, comprehensives, or other preliminary materials, which are not selected by the client or are not included into the final delivery, remain the full property of fish tales studio.
In the event that payment for any cartoon design is not made in accordance with the payment policies of fish tales studio, then all of client's rights in and to the design created for it, including any trademark property, will immediately revert back to fish tales studio.
Although each cartoon design is created from scratch and is 100% original, fish tales studio cannot guarantee that a very similar cartoon does not already exist. Fish tales studio therefore offers no guarantee regarding the availability of trade names or trademarks. If a similar cartoon exists, Fish tales studio will work with the client to make the necessary alterations to the cartoon, free of charge. However, by ordering a cartoon design from Fish tales studio, the customer indemnifies Fish tales studio, it's owners and affiliated companies/affiliated individuals/cartoon designers from legal responsibility regarding all copyright, trade name and trademark issues. The customer agrees to take sole legal responsibility should the cartoon design be infringent upon existing intellectual property rights, copyrighted material, trade names or trademarks of any kind.
You are solely responsible for your use of Content in combination with any other images, graphics, text or other materials you incorporate into the Product(s). You agree that you will not include, or request for the inclusion of, any Intellectual Property Rights in the Product(s) unless you have obtained the appropriate required rights or licences from their respective owners. You warrant that the Product(s) does not infringe upon any Intellectual Property Rights of any third party, will not libel or defame any third party, and are not in contravention of any subsisting and applicable law. By placing an order with Fishtalesstudio.com, you warrant that you have the necessary authority, rights and licences to place the order and you authorize Fishtalesstudio.com to produce the Product(s) on your behalf. You also agree to indemnify and hold harmless Fishtalesstudio.com from all claims, demands, costs, expenses (including but not limited to legal costs and disbursements), losses and damages arising from or suffered or incurred that may arise in connection to the Product(s).

CARTOON +ANIMATE CARICATURE:

Ownership (copyright and title) of the final artwork becomes the property of the Fish tales studio. All artwork created for individuals or organizations is for personal use only and not to be reprinted, published, duplicated or used for any commercial applications without the consent of Fish tales studio. Fish tales studio reserves the right to reuse/reproduce images of artworks which we have created, and/or their likeness or derivations, in any manner. In the event that the customer wishes we do not use art/images created for said customer in any other manner, and expresses so in writing, we will respectfully refrain from reproducing such images.

ITEMS OFFERED THROUGH AFFILIATE PROGRAMS:

Products including t-shirts, posters, prints, and others, may be displayed on the Fish tales studio website, but produced and/or sold by other companies through affiliate programs in which Fish tales studio is involved. Fish tales studio does not warrant or guarantee any of such products. Problems, issues, concerns or questions resulting from the purchase of such items are to be directed to the company which produced/provided and shipped the items. Information displayed including descriptions, prices and other information related to such items is not provided by Fish tales studio, therefore, Fish tales studio has no obligation to the accuracy of information.
